These Terms & Conditions govern your use of www.adsbyg5.com and any performance marketing services provided by ADS BY G5 ("ADS BY G5", "we", "us" or "our"). By accessing this website or engaging our services, you agree to these terms.

1. About us

2. Use of this website

  • You agree to use this website lawfully and not to attempt to disrupt, damage or gain unauthorised access to it.
  • You may not copy, reproduce, scrape or redistribute website content without our written permission.
  • We may modify, suspend or withdraw any part of the website without notice.

3. Enquiries and communication

Enquiries submitted through our website are routed to WhatsApp on your own device for you to send to our business number. Submitting an enquiry does not create a contract or an obligation on either party. Any engagement begins only after a written proposal or agreement is accepted.

4. Services

  • Scope, deliverables, timelines, fees and payment terms for any engagement are defined in a separate proposal, statement of work or agreement.
  • Advertising media spend is separate from our service fees and is payable directly to the relevant advertising platform unless agreed otherwise in writing.
  • You are responsible for providing accurate business information, brand assets, required approvals and timely access to advertising accounts, analytics and other platforms needed to deliver the work.

5. No guarantee of results

Advertising performance depends on many factors outside our control, including platform algorithms, auction dynamics, competition, market conditions, product-market fit, pricing, website experience and your internal operations. ADS BY G5 does not guarantee specific revenue, ROAS, CAC, CPL, lead volume, ranking or sales outcomes. Any figures, benchmarks or past performance shared are illustrative and not a promise of future results.

6. Third-party platforms

Our services involve third-party platforms including Meta, Google, Amazon, LinkedIn, Snapchat, TikTok and Hotstar. Your use of those platforms is subject to their own terms and policies. We are not responsible for platform outages, policy changes, account restrictions, ad disapprovals or suspensions imposed by those platforms.

7. Client responsibilities and compliance

You confirm that the products, services, claims and creative assets you ask us to advertise are lawful, accurate and compliant with applicable advertising regulations and platform policies. You remain responsible for the legality of your offering and for any claims made about it.

8. Fees and payment

Fees, billing cycles and applicable taxes are set out in your proposal or agreement. Unless stated otherwise, invoices are payable in advance of the service period. We may pause work on overdue accounts.

9. Intellectual property

All website content, branding and materials created by ADS BY G5 remain our intellectual property unless expressly transferred in writing. On full payment, you receive a licence to use campaign assets created for you for your own advertising purposes. You retain ownership of your brand assets and grant us a licence to use them for delivering and, where permitted, showcasing the work.

10. Confidentiality

Both parties agree to keep non-public business, campaign and commercial information confidential and to use it only for the purpose of the engagement.

11. Limitation of liability

To the maximum extent permitted by law, ADS BY G5 is not liable for indirect, incidental, special or consequential losses, including loss of profit, revenue, data or goodwill. Our total aggregate liability in connection with any engagement will not exceed the service fees paid to us in the three months preceding the claim.

12. Termination

Either party may terminate an engagement in line with the notice period stated in the agreement. Fees for work already performed and committed media remain payable.

13. Governing law

These terms are governed by the laws of India, and the courts of New Delhi have exclusive jurisdiction over any dispute.

14. Changes to these terms

We may update these Terms & Conditions from time to time. Continued use of the website after an update constitutes acceptance of the revised terms.
